At Lahda (“we,” “us,” or “our”), we respect your privacy and are committed to protecting your personal information. This Privacy Policy explains how we collect, use, and safeguard your data when you use our recruitment and advertising platform.

1. Information We Collect

We collect information in several ways, depending on how you use our Service:

1.1 Information You Provide to Us

We collect information you provide directly to us, such as when you create an account, create a campaign, post a job, or communicate with support. This may include:

  • Account Information: Name, email address, company name, phone number, and password.
  • Billing Information: Payment details, billing address, and payment method information (processed by our secure payment processors).
  • Campaign and Job Information: Job descriptions, job titles, locations, qualifications, ad copy, images, and other content you upload for your campaigns.
  • Communication Data: Messages you send to us, support requests, feedback, and other communications.

1.2 Applicant Information

When individuals apply to jobs through our platform, we collect information provided by applicants, including:

  • Application Data: Name, email address, phone number, resume, cover letter, and answers to application questions.
  • Text Messaging Opt-In Data: If applicants opt in to receive text message communications, we collect their phone number and consent information. This data is handled separately and subject to additional protections as described in Section 3.

Applicant information is shared with the campaign owner (employer) for whom the application was submitted. Applicants should review the privacy practices of the employers they apply to.

1.3 Automatically Collected Information

When you use our Service, we automatically collect certain information, including:

  • Usage Data: Information about how you interact with our platform, including pages visited, features used, time spent, clicks, and navigation patterns.
  • Device Information: IP address, browser type, operating system, device identifiers, and mobile network information.
  • Advertising Data: Campaign performance metrics, impressions, clicks, conversions, and other advertising analytics from Meta platforms.
  • Log Data: Server logs, including access times, pages viewed, and error logs.
  • Cookies and Tracking Technologies: We use cookies, web beacons, and similar technologies to collect information about your interactions with our Service. See Section 9 for more details.

2. How We Use Your Information

We use the collected information for the following purposes:

  • Service Delivery: Provide, maintain, and improve our services, including creating and managing advertising campaigns on Meta platforms.
  • Campaign Management: Create, run, and optimize your advertising campaigns, generate AI-powered ad creative and copy, and manage campaign performance.
  • Application Processing: Facilitate job applications, collect applicant information, and share applications with campaign owners (employers).
  • Payment Processing: Process transactions, send confirmations and invoices, and manage billing for advertising spend and platform fees.
  • Communication: Send you technical notices, updates, security alerts, support messages, and campaign-related notifications via email or SMS (with your consent).
  • Customer Support: Respond to your comments, questions, requests, and provide customer support.
  • Analytics and Improvement: Analyze trends, usage patterns, and campaign performance to optimize our platform, improve our services, and develop new features.
  • Security and Fraud Prevention: Detect, investigate, and prevent fraudulent transactions, unauthorized access, and other illegal activities.
  • Legal Compliance: Comply with applicable laws, regulations, legal processes, and enforce our Terms of Service.

3. Data Sharing and Disclosure

We do not sell your personal information. We may share your information in the following circumstances:

3.1 Third-Party Service Providers

We share information with third-party service providers who perform services on our behalf. These providers are contractually obligated to protect your information and use it only for the purposes we specify:

  • Meta (Facebook/Instagram): We share campaign information, ad content, and targeting data with Meta to run your advertising campaigns on their platform. Meta has its own privacy policy and terms that apply to your use of their advertising services.
  • Stripe: We share payment and billing information with Stripe to process payments. Stripe processes your payment information according to their privacy policy and security standards.
  • Twilio: We share phone numbers and SMS content with Twilio to send text message notifications. See Section 3.2 below regarding text messaging opt-in data protection.
  • Mailgun: We share email addresses and email content with Mailgun to send transactional and notification emails.
  • Firebase/Google Cloud: We use Google Cloud Platform (including Firebase) for hosting, data storage, and backend infrastructure services.
  • Google/Gemini: We share job descriptions and campaign content with Google’s Gemini AI service to generate ad creative and copy.
  • Other Service Providers: Analytics providers, customer support tools, and other vendors necessary to operate our Service.

3.2 Text Messaging Opt-In Data Protection

IMPORTANT: Text messaging originator opt-in data and consent information collected for SMS communications will not be shared with any third parties, except as strictly necessary to deliver SMS messages through our SMS service provider (Twilio). This opt-in consent data will not be used for marketing purposes by third parties, sold, or shared for any other commercial purpose. This protection applies separately from other categories of data we collect and is subject to additional safeguards.

3.3 Campaign Owners (Employers)

When applicants apply to jobs through our platform, we share applicant information with the campaign owner (employer) for whom the application was submitted. This includes name, contact information, resume, application answers, SMS consent status, and other information provided by the applicant. Campaign owners are responsible for their own privacy practices regarding applicant data.

Important Disclaimer: Lahda is not responsible for how campaign owners (employers) use applicant data, including but not limited to their texting practices, communication methods, or compliance with applicable laws and regulations such as the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or state-specific texting regulations. While we provide SMS consent information to help employers comply with regulations, employers are solely responsible for:

  • Respecting applicant SMS consent preferences and not sending text messages to applicants who have not consented
  • Complying with all applicable texting and communication regulations
  • Obtaining proper consent before sending any text messages to applicants
  • Maintaining records of consent as required by applicable laws
  • Any violations, claims, or legal actions arising from their use of applicant contact information

Lahda acts solely as an intermediary platform and disclaims all liability for employer misuse of applicant data, including texting practices, spam, harassment, or violations of texting regulations. Any actions taken by employers using applicant contact information are the sole responsibility of the employer.

3.4 Legal Requirements

We may disclose your information if required to do so by law or in response to a valid request by a governmental or regulatory authority, or if we believe disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a legal process.

3.5 Business Transfers

In connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business, we may share your information with the acquiring or merging entity. We will notify you of any such change in ownership or control of your personal information.

4. Data Security

We take reasonable technical and organizational measures to help protect information about you from loss, theft, misuse, and unauthorized access, disclosure, alteration, and destruction. This includes encryption of data in transit and at rest, secure authentication methods, regular security assessments, and access controls. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

5. Data Retention

We retain your personal information for as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. Specifically:

  • Account Data: We retain account information for as long as your account is active or as needed to provide services. If you delete your account, we may retain certain information for legal, regulatory, or business purposes.
  • Campaign Data: Campaign information is retained while your campaigns are active and for a reasonable period afterward for record-keeping and analytics purposes.
  • Applicant Data: Applicant information is retained and shared with campaign owners. We may retain this data for campaign owners’ records and business purposes.
  • Billing Records: Payment and billing information is retained as required by law, typically for at least 7 years for tax and accounting purposes.
  • Text Messaging Opt-In Data: Retained only as long as necessary to provide SMS services and in accordance with applicable SMS regulations.

You may request deletion of your data by contacting us at support@lahda.co or by using the data deletion features in your account settings. For more information about data deletion, please see our Data Deletion Policy.

6. Your Rights

Depending on your location, you may have certain rights regarding your personal information, including:

  • Access: The right to access and receive a copy of your personal information.
  • Correction: The right to correct inaccurate or incomplete information.
  • Deletion: The right to request deletion of your personal information, subject to legal and business requirements.
  • Portability: The right to receive your data in a structured, machine-readable format.
  • Opt-Out: The right to opt out of certain communications, including marketing emails and SMS messages (you can opt out of SMS by replying “STOP”).
  • Objection: The right to object to processing of your personal information in certain circumstances.

To exercise these rights, you can manage your account settings within the application, update your communication preferences, or contact us at support@lahda.co. We will respond to your request within a reasonable timeframe and in accordance with applicable law.

7. Applicant Data and Privacy

When you apply to a job through our platform:

  • Your application information, including contact details, resume, answers to application questions, and SMS consent status, is shared with the campaign owner (employer) for whom you applied.
  • Campaign owners may use your information to evaluate your application, contact you about the position, and for their own hiring and record-keeping purposes.
  • We are not responsible for how campaign owners handle or use your applicant data, including their texting practices, communication methods, or compliance with applicable laws and regulations. Please review the privacy practices of the employers you apply to.
  • Lahda is not liable for any misuse of your contact information by employers, including but not limited to violations of texting regulations (such as TCPA), spam, harassment, or unauthorized communications. Any claims or legal actions arising from employer misuse of your contact information should be directed to the employer, not Lahda.
  • You have the right to request access to, correction of, or deletion of your applicant data by contacting us at support@lahda.co.
  • If you opt in to receive text message communications, your opt-in consent data is protected as described in Section 3.2. However, Lahda is not responsible for employer compliance with texting regulations or for any violations committed by employers when using your contact information.

8. Cookies and Tracking Technologies

We use cookies, web beacons, and similar tracking technologies to collect and store information about your interactions with our Service. Cookies are small data files stored on your device that help us improve your experience, analyze usage patterns, and deliver personalized content.

Types of cookies we use:

  • Essential Cookies: Required for the Service to function properly (e.g., authentication, security).
  • Analytics Cookies: Help us understand how users interact with our Service to improve functionality.
  • Functional Cookies: Remember your preferences and settings to provide enhanced features.

Most web browsers allow you to control cookies through their settings. However, disabling certain cookies may limit your ability to use some features of our Service.

9. Children’s Privacy

Our Service is not intended for individuals under the age of 18. We do not knowingly collect personal information from children under 18. 10. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence. These countries may have data protection laws that differ from those in your country. By using our Service, you consent to the transfer of your information to these countries. We take appropriate safeguards to ensure your information receives an adequate level of protection.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will notify you of any material changes by posting the new Privacy Policy on this page and updating the “Last updated” date. We may also notify you via email or through the Service for significant changes. Your continued use of the Service after such changes constitutes acceptance of the updated Privacy Policy.
